In Commonwealth of Massachusetts v. Health and Human Services, Tauro considered whether the federal law’s definition of marriage -- one man and one woman -- violates state sovereignty by treating some couples with Massachusetts’ marriage licenses differently than others. In Gill v. Office of Personnel Management, Gay & Lesbian Advocates & Defenders (GLAD), a gay legal group, asked Tauro to consider whether DOMA violates the right of eight same-sex couples to equal protection of the law. Both cases were argued, separately, in May, and the decision released today is a relatively quick turnaround, given that some judges take almost a year to decide cases.

Very interesting legal rulings! I agree with the legal reasoning in both cases.

And I also agree that the Obama Admin will be obnoxious enough to launch an appeal all the way to the Supreme Court, given their track record of defending Bush Admin policies.

Obama Admin has defended rendition, torture, permanent detention, Gitmo and DADT in federal court so I can't see why they wouldn't continue playing that game here.

I approve of the discrimination decision but can't relate it to the National Day of Prayer decision. As I understand the prayer decision, the demand for appeal is being pushed by the American Center for Law and Justice (ACLJ), founded by fundamentalist evangelical Pat Roberson and supported by 70 US senators, not the DOJ. Are you saying the DOJ is pandering to the ACLJ cause due to the senatorial support?

The Obama administration will fight to preserve the law establishing an annual National Day of Prayer, the Justice Department confirmed Thursday. The law was declared unconstitutional last week by a federal judge.
The Justice Department's official filing of a "notice to appeal" Thursday came as no surprise, after White House spokesman Matt Lehrich said following the ruling that President Barack Obama intends to recognize this year's National Day of Prayer, which is May 6.
U.S. District Court Judge Barbara Crabb in Wisconsin ruled on April 15 that the 1952 law creating the National Day of Prayer violates the ban on government-backed religion.

The ruling produced predictable reactions, with most religious groups sharply criticizing it and groups backing a strict separation of church and state applauding it.
The injunction against the National Day of Prayer would not take effect until the appeals have been exhausted.
The case is Freedom From Religion v President Barack Obama, White House Press Secretary Robert Gibbs, and Wisconsin Gov. Jim Doyle.
